Family Code opens windows to legal equity in Cuba

One of the current premises of Cuban governmental institutions is to achieve a more equitable and protected society in legal matters, and the new Family Code bill is being promoted to this end.

Therefore, the process for the approval of new provisions is being extended with this bill, which will be discussed until April 30, before being submitted to a popular vote.

In an exclusive interview with Prensa Latina, Iris Cabanes, professor at the Law Department at the University of Camagüey, commented on several issues of the Family Code that open windows to the provision of new laws.

“There are legal deficiencies in our society, and the Family Code tells you a lot about mediation, advocates that family conflicts should not be resolved in court in litigation, but through mediation in a peaceful way, taking into account other parameters, but there is no mediation law in our country.”

This expert added that “the Family Code itself establishes guidelines for new legal norms without which it would not be totally effective.”

She noted that, “for example, the Family Code deals with gender and family violence, but we still do not have a law against this type of violence,” a situation that is not alien to any society.

In addition to its more than 400 headings and particularities, “the Family Code also introduces, from the point of view of parentage, the technique of assisted reproduction, and although the medical procedure already exists, there is no law on assisted reproduction in our country.”
