Cuba’s Prosecutor’s Office Announces Protocol to Address Racial Discrimination

Cuba’s Office of the Attorney General has implemented a protocol aimed at preventing and addressing racial discrimination, outlining how prosecutors must respond to complaints and allegations related to such acts.

Cuba’s Office of the Attorney General established the Protocol for Action to Prevent and Address Racial Discrimination through Resolution No. 16 of 2023, according to a directive issued by the Attorney General of the Republic.

According to information published by the institution on its Facebook profile, the document sets out the procedures prosecutors must follow when dealing with statements, complaints, petitions, and reports related to acts of racial discrimination. The protocol is aligned with the provisions of the Constitution of the Republic and the National Program against Racism and Racial Discrimination approved by the Executive Committee of the Council of Ministers.

The regulation is based on Article 156 of the Constitution, which defines the fundamental mission of the Office of the Attorney General, as well as Law No. 160, which establishes the guiding principles governing the institution’s work.

It also incorporates provisions contained in Resolution No. 2 of 2022 issued by the Attorney General, which outlines procedures for receiving and processing complaints, petitions, and reports submitted by individuals to the Prosecutor’s Office.

In addition, the protocol includes provisions from Resolution No. 3 of 2022 concerning the role of prosecutors in family protection proceedings and jurisdictional matters.

The document also incorporates elements established in Resolution No. 5 of 2022, which regulates procedures for overseeing legality in penitentiary institutions, with the aim of ensuring the protection of citizens’ rights.
